Welcome to EasyVAClaims. These Terms of Service ("Terms") govern your access to and use of the EasyVAClaims website, software, and services (collectively, the "Services"). Please read these Terms carefully and in their entirety before using our Services.

By creating an account, accessing our website, or using our Services in any manner, you agree to be bound by these Terms, our Privacy Policy, and all applicable laws and regulations. If you do not agree with any part of these Terms, you are prohibited from using our Services and must discontinue use immediately.

1. Important Disclaimers

Please read this section carefully. It contains critical information regarding the scope and limitations of our Services.

Not Affiliated with the Department of Veterans Affairs. EasyVAClaims is an independent, private-sector software company. It is not part of, endorsed by, affiliated with, or in any way officially connected with the U.S. Department of Veterans Affairs ("VA"), the U.S. Department of Defense, or any other government agency.

Not Legal, Medical, or Financial Advice. The Services do not provide legal, medical, financial, or any other form of professional advice. EasyVAClaims is a self-help educational tool. We are not a law firm, not a medical provider, and not a financial advisor.

Not an Accredited VA Claims Agent, Attorney, or Representative. EasyVAClaims is not accredited by the VA under 38 C.F.R. § 14.629 to prepare, present, or prosecute claims for VA benefits. We do not act as your agent, attorney, or representative before the VA. Under 38 U.S.C. § 5901, only accredited individuals may act as agents or attorneys in the preparation, presentation, or prosecution of VA claims.

No Guarantee of Outcome. EasyVAClaims makes no promises, representations, warranties, or guarantees — express or implied — regarding the outcome of your VA disability claim. Any estimated ratings, potential benefit amounts, or other projections displayed within the Services are for informational and educational purposes only.

You Are Responsible for Your Claim. You, the user, are solely responsible for the accuracy, completeness, truthfulness, and submission of your VA disability claim and all supporting documents.

2. Description of Services & the "Software as a Tool" Doctrine

EasyVAClaims provides a self-help software platform designed to assist veterans in organizing, preparing, and understanding the documents commonly associated with a VA disability claim. Our Services function as a sophisticated word processor, organizational assistant, and educational resource.

You are in control of your claim at all times. No agent-principal relationship, attorney-client relationship, or any other professional-client relationship is created by your use of the Services.

The Services may include: a guided claims wizard, document templates, educational content, estimated disability rating calculators, personal statement drafting assistance, and evidence organization tools. Each is provided for educational and informational purposes.

3. User Eligibility and Account Responsibilities

You must be at least eighteen (18) years of age to use the Services.

If you create an account, you are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

You are solely responsible for the truthfulness, accuracy, and completeness of all information you input into the Services. You agree to carefully review all documents generated or assisted by the Services before submitting them to the VA.

4. Prohibited Uses

You agree not to use the Services to:

Input any information that is false, fraudulent, or intentionally misleading.
Prepare or submit a fraudulent claim to the VA. Filing a false claim is a federal crime under 18 U.S.C. § 1001.
Violate any applicable law or regulation.
Infringe upon intellectual property rights of EasyVAClaims or any third party.
Transmit any viruses, worms, malware, or other malicious code.
Attempt to gain unauthorized access to our systems or other user accounts.
Use the Services to compete with EasyVAClaims, including scraping or reverse-engineering.
Use the Services on behalf of another person without their explicit consent.

We reserve the right to terminate your access immediately for any violation.

5. AI-Assisted Content & Automated Tools

Certain features utilize artificial intelligence ("AI") to help you draft, organize, and refine your documents. By using these features, you acknowledge:

You Are the Author. All AI-generated text is provided as a draft or template for your review. By submitting any AI-assisted document, you adopt that content as your own work and represent it is truthful and accurate.

No Guarantee of Accuracy. AI-generated content may contain errors, inaccuracies, or outdated information.

Your Responsibility to Verify. You are solely responsible for verifying the factual accuracy of all content before using it in your claim.

6. Free Services, Paid Services, and What You Are Paying For

The core EasyVAClaims claims preparation wizard is provided free of charge.

EasyVAClaims may offer optional, premium features for a fee. Your payment is for a one-time license to access those specific premium tools. Your payment is not a fee for claims preparation assistance, claims filing, or representation before the VA. Your payment is not contingent on the outcome of your VA claim.

EasyVAClaims may also offer links to separate, independent third-party services. These are governed by their own terms and conditions.

7. Satisfaction Guarantee & Refund Policy

If you are not satisfied with a paid purchase for any reason, contact us within thirty (30) days of your purchase date for a full refund. No paperwork, no questions asked.

7.1 How to Request a Refund

Email support@easyvaclaims.com with the subject line "Refund Request" and include your order number. We will process your refund within five to seven (5–7) business days.

7.2 Limitation

This guarantee may be used once per customer. Requests submitted more than thirty (30) days after purchase are not eligible.

8. Testimonials, Reviews, and Success Stories

Testimonials reflect individual experiences and are not intended to guarantee that any other user will achieve similar results. No testimonial should be interpreted as a promise, guarantee, or prediction of your claim outcome.

9. Dispute Resolution by Binding Arbitration & Class Action Waiver

Please read this section carefully. It affects your legal rights.

9.1 Agreement to Arbitrate

You and EasyVAClaims agree that any disputes shall be resolved exclusively through final and binding individual arbitration, rather than in a court of law.

9.2 Class Action Waiver

Each party may bring claims only in individual capacity, not as a plaintiff or class member in any purported class, collective, or representative proceeding.

9.3 Arbitration Rules and Procedures

Arbitration will be administered by the American Arbitration Association under its Consumer Arbitration Rules. The seat of arbitration shall be in the State of Florida.

9.4 Opt-Out Provision

You may opt out within thirty (30) days of first becoming subject to this provision by sending written notification to EasyVAClaims at the contact address in Section 17.

9.5 Exceptions

Either party may bring an individual action in small claims court. This agreement does not preclude you from bringing issues to the attention of government agencies.

10. Limitation of Liability

To the fullest extent permitted by applicable law:

In no event shall EasyVAClaims be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, data, or goodwill, resulting from your use of the Services, the denial of your VA claim, or any errors in content provided through the Services.

In no event shall the aggregate liability exceed the greater of one hundred U.S. dollars ($100.00) or the total amount you have paid to EasyVAClaims in the preceding six (6) months.

11. Indemnification

You agree to defend, indemnify, and hold harmless EasyVAClaims from and against any claims arising from your use of the Services, violation of these Terms, or any content you input into or generate using the Services. This obligation survives termination.

12. Not a Healthcare Provider; Emergency Situations

EasyVAClaims is not a healthcare provider or crisis intervention service.

13. Intellectual Property

The EasyVAClaims platform is protected by copyright, trademark, and other IP laws. Documents prepared using our tools are yours for filing your VA claim. The underlying templates, algorithms, AI models, and software remain the exclusive property of EasyVAClaims.

14. Third-Party Services and Links

The Services may contain links to third-party websites. EasyVAClaims has no control over, and assumes no responsibility for, third-party content, privacy policies, or practices.

15. Account Termination

We may terminate or suspend your account immediately for any breach of these Terms. You may terminate your account by contacting support@easyvaclaims.com.

16. Governing Law, Venue, and Jurisdiction

These Terms shall be governed by the laws of the State of Florida. You and EasyVAClaims agree to submit to the personal and exclusive jurisdiction of the courts located within the State of Florida.

17. General Provisions

17.1 Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and EasyVAClaims regarding the Services.

17.2 Severability

If any provision is held invalid, the remaining provisions remain in full force and effect.

17.3 Waiver

Failure to enforce any right or provision shall not be deemed a waiver of such right.

17.4 Assignment

You may not assign these Terms without prior written consent. EasyVAClaims may assign without restriction.

17.5 Force Majeure

EasyVAClaims shall not be liable for failures due to circumstances beyond its reasonable control.

17.6 Changes to Terms

We reserve the right to modify these Terms. Material changes will be communicated with at least thirty (30) days' notice.

17.7 Electronic Communications

By using the Services, you consent to receiving electronic communications from us.
